GENERAL TERMS AND CONDITIONS | GT MAX APP
1. General Information
The GT MAX application (hereinafter the “APP”) is owned by Mac&Nil S.r.l. (hereinafter “Macnil GT ALARM”), which, as Data Controller (hereinafter the “Controller”), with registered office at viale L. Pasteur, 26 – 70024 Gravina in Puglia (BA), wishes to provide you with the following information regarding the installation and use of the App.
By accessing and/or using our APP, you (hereinafter also the “User”), as data subject (“Data Subject”), accept the terms of these General Conditions of Use (hereinafter the “Conditions”) and consent to your personal data being collected, used and disclosed in accordance with these Conditions. Should you not accept these Conditions, we invite you not to access and/or use our App and not to provide us with any personal data.
These Conditions govern access to, navigation of and use of the GT MAX APP by users; all users are advised to read this document carefully.
In any case, the Controller reserves the right to make any changes it deems necessary, both to the content of the Conditions and to the configuration of the APP, with reference to the systems for accessing and using the contents and services, without any need for prior notice.
2. General Conditions of Use of the GT MAX APP
The APP is designed to be used by Macnil GT ALARM customers through their mobile device and/or tablet, being available on the Google Play and App Store stores.
To use the APP, a data network (mobile or WiFi) is required. Once installed on the mobile device or tablet, the User must:
1) Turn on the Bluetooth of their smartphone in order to communicate with the GT MAX
2) Scan the QR Code located inside the GT MAX box
3) Register through the form that will appear in the app to receive the access password at their e-mail address
4) Enter username and password to log in
5) Once inside the app, it will be possible to interact with your GT MAX electronic anti-theft system, installed on board the car,
directly from your smartphone. Specifically:
– Arm and disarm the anti-theft system from the app
– Arm the anti-theft system with the volumetric sensor excluded
– Unlock the vehicle’s ignition (if the configuration allows it)
– Check the status of the vehicle (ignition, doors, bonnet, boot)
– View all accessories associated with the GT MAX and check their battery status
– Check the possible availability of a software update for the device in the Report section of the app (software update to be carried out at your authorised Installer)
– Check the latest alarms received directly in the Report section of the app
The User must, at all times, use the contents and services of the APP appropriately, in accordance with the applicable legislation, morality, the principles required in good faith and these Conditions. Furthermore, the User undertakes not to transmit, introduce, disseminate or make available to third parties any type of material and information (data, messages, drawings, audio and image files, photographs, software, etc.) in violation of the law, morality, public order and the following Conditions. In this regard, by way of example but not limited to, we invite the User to:
– not introduce or disseminate content or messages of a racist, xenophobic or pornographic nature, that support terrorism or that violate human rights;
– not introduce or disseminate programs (viruses and malware) that could cause damage to the computer systems of Macnil GT ALARM, its suppliers or third-party users through the APP;
– not disseminate, transmit or make available to third parties through the APP any type of information, element or content that violates the fundamental rights and freedoms recognised by national and international legislation;
– not disclose, transmit or make available to third parties, through the APP, any type of information, element or content that constitutes unlawful or unfair advertising;
– not transmit advertising or advertising material of any kind that is unsolicited or unauthorised, through the APP;
– not introduce or disclose false, ambiguous or improper information and content in order to deceive third parties, through the APP;
– not impersonate other users by using their APP access credentials;
– not disseminate, transmit or make available to third parties, through the APP, any type of information or content in violation of the intellectual property rights, patents, trademarks or copyrights of Macnil GT ALARM;
– not disclose, transmit or make available to third parties, through the APP, any type of information, element or content that entails a violation of the confidentiality of communications and of the legislation on the protection of personal data.
Macnil GT ALARM will provide the User with the credentials for accessing the APP, which can be changed by the User at any time (for security reasons, the Controller recommends that all its Users periodically change their credentials).
The User is required to correctly use and safeguard their APP access credentials, as well as to keep them secret and not provide them to third parties. Should the access credentials be lost or forgotten, new credentials will be provided through the password recovery procedure available within the APP. Any conduct contrary to the above may also be pursued through legal action by Macnil GT ALARM, as any type of unlawful use of the APP that is contrary to public order, public decency or that violates the rights and freedoms of third parties is expressly prohibited. Furthermore, the Controller reserves the right to limit access to the APP should circumstances so require, and for any consequence, for which the Controller is not responsible, to the detriment of the User or that the latter may suffer due to improper use of the APP or due to negligent use of the access credentials, as well as should the latter be provided to third parties other than the User authorised to access.
The use of the APP is exclusive and personal.
3. Data Protection
3.1 The Controller guarantees strict compliance with all the duties and obligations provided for by the applicable legislation on the protection
of personal data, ensuring the necessary safeguards. The Data Subject authorises the processing, including automated processing, and the storage of their personal data by the Controller.
Macnil GT ALARM guarantees, under these Conditions, the absolute confidentiality of the personal data provided by Users, applying the necessary security measures for the protection of personal data in order to prevent any alteration, loss, unauthorised access or improper use of such data. The User, for their part, undertakes to ensure and maintain the confidentiality of all data provided by Macnil GT ALARM, in particular the relevant access credentials
3.2 Purposes of the processing
The processing, including automated processing, of the personal data provided by the Data Subject is intended to:
• offer the services provided by the APP;
• manage all requests from the Data Subject;
• improve and develop the APP itself.
Furthermore, the Controller may use the Data Subject’s data, including anonymously, for statistical purposes or to provide the User with general or personalised offers, including through the APP.
We also collect and use the Data Subject’s personal data in order to fulfil the obligations provided for by law, including those of an administrative, insurance, accounting and tax nature connected to the provision of the requested services.
3.3 Retention of personal data
The Data Subject’s personal data will be retained for a period of time not exceeding that necessary for the purposes referred to in point 3.2 of these Conditions, and also for a subsequent period:
• within the terms established by the applicable legislation;
• within the terms established by the legislation and regulations that require the retention of data (for example tax returns);
• within the period necessary to protect the Controller’s rights in the event of any disputes related to the provision of our services.
3.4 Rights of the Data Subject
The Data Subject has the right to:
a) access their personal data;
b) make corrections to their personal data;
c) withdraw consent at any time to our use and disclosure of their personal data;
d) withdraw consent at any time to receiving commercial information on the services and products offered by the Controller,
including through the APP;
e) request the deletion of their personal data at any time;
f) receive, in a structured, commonly used and machine-readable format, the personal data concerning them,
as well as transmit their data to another data controller;
g) obtain the restriction of the processing of their personal data;
h) request information regarding:
i. the purposes of the processing;
ii. the categories of personal data;
iii. the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular whether the data
are transmitted to recipients in third countries or international organisations;
iv. the retention period of the personal data;
v. the right to lodge a complaint with a supervisory authority;
vi. should the data not be collected from the data subject, all available information on their origin.
To exercise their rights or to receive any further information on the processing of personal data, the Data Subject may contact the Controller at any time at the address indicated within the General Information of this document, or by e-mail at the address info@macnil.it or by calling the number +39 080 246 42 45 or by sending a certified e-mail (PEC) to the address macnil@pec.it.
4. Intellectual and industrial property rights:
The various contents of the APP are protected by intellectual and industrial property rights. The use for unlawful purposes, the exploitation, reproduction, public disclosure or unauthorised distribution of the APP is prohibited.
The APP belongs to Macnil GT ALARM; the User undertakes not to delete, modify or alter any distinctive sign used as a trademark or trade name (graphics, logo, etc.), protected by copyright, as well as not to unlawfully exploit or use the communications, symbols, labels or any other element of Macnil GT ALARM present within the APP.
The Data Subject acknowledges that the reproduction, modification, distribution, commercialisation, decompilation, dismantling, the use of reverse engineering techniques or any other means aimed at obtaining the source code, the transformation or publication of any unauthorised testing result, of elements and utilities integrated into the APP, constitute an infringement of the intellectual property rights of Macnil GT ALARM; consequently, it is prohibited to carry out any type of unauthorised operation and/or operation connected to the activities listed above.
Users may view, use, print, download and store the various contents only for domestic and personal use, subject to the express authorisation of Macnil GT ALARM, in accordance with this document.
The Controller reserves the right to limit access to the APP for those who fail to comply with the provisions set out in the following Conditions.
5. Exclusion of liability:
The Controller is not responsible for any damages or losses that may result from the use of the APP and, in particular, in the following cases:
– fraudulent or negligent use of the contents and services of the APP by Data Subjects or third parties;
– unlawful use of the contents and services of the APP;
– technical defects, as well as any difficulty caused by them;
– transmission of malware or other harmful elements to the Data Subject’s terminal;
– lack of availability or accessibility of the APP;
– truthfulness of the information provided by the Data Subject;
– truthfulness, reliability, timeliness or accuracy of the contents provided by third parties or any links to third-party websites
published within the APP.
6. Jurisdiction and applicable legislation:
These Conditions, as well as the contents of the APP, are subject to and governed by national legislation and by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, as well as on the free movement of such data.
